TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the Build Ohio First website and its related content, resources, forms, advocacy tools, and services (collectively, the “Site”).
Build Ohio First is an initiative of Powering Prosperity (“Build Ohio First,” “Powering Prosperity,” “we,” “our,” or “us”).
By accessing or using the Site, you agree to these Terms. If you do not agree, please discontinue use of the Site.
PURPOSE OF THE SITE
Build Ohio First provides information, educational resources, news, advocacy opportunities, and other content related to energy, infrastructure, economic growth, public policy, and issues affecting Ohio.
The Site may also provide opportunities for individuals to sign up for communications, participate in grassroots activities, contact public officials, or otherwise engage with Build Ohio First and Powering Prosperity.
We may modify, suspend, discontinue, or restrict any portion of the Site at any time without notice.
ACCEPTABLE USE
You agree to use the Site only for lawful purposes and in accordance with these Terms.
You may not:
Use the Site in violation of any applicable law or regulation;
Attempt to gain unauthorized access to the Site, its servers, databases, or related systems;
Interfere with or disrupt the operation or security of the Site;
Introduce viruses, malicious code, or other harmful technology;
Use automated systems to scrape, harvest, or improperly obtain information from the Site;
Impersonate another individual or organization;
Submit false, fraudulent, misleading, defamatory, threatening, abusive, or unlawful material;
Use the Site to infringe upon the intellectual-property, privacy, or other rights of another person or organization; or
Attempt to use the Site in a manner that could damage Build Ohio First, Powering Prosperity, other users, or third parties.
We reserve the right to restrict or terminate access to the Site for conduct we believe violates these Terms or is otherwise harmful or inappropriate.
ADVOCACY TOOLS
The Site may provide tools that allow you to participate in grassroots advocacy, including petitions, sign-up forms, calls to action, or tools for communicating with elected officials and other public officials.
Some advocacy services may be provided through third-party platforms or service providers.
When you choose to participate in an advocacy action, you are responsible for the information and communications you submit. Information you provide may be transmitted to the intended recipient and processed by service providers as necessary to carry out your requested action.
Your use of third-party advocacy tools may also be subject to additional terms and privacy policies established by those providers.
INTELLECTUAL PROPERTY
Unless otherwise indicated, the Site and its content—including text, graphics, logos, designs, photographs, videos, audio, trademarks, service marks, and other materials—are owned by, licensed to, or used with permission by Build Ohio First, Powering Prosperity, or their respective licensors.
The content is protected by applicable copyright, trademark, and other intellectual-property laws.
You may access and use Site content for personal, informational, and lawful noncommercial purposes.
You may not reproduce, modify, distribute, sell, license, publish, create derivative works from, or commercially exploit Site content without prior written permission from the applicable rights holder, except as otherwise permitted by law.
USER SUBMISSIONS
If you submit comments, feedback, suggestions, stories, photographs, materials, or other content to us, you represent that you have the right to provide those materials and that doing so does not violate the rights of another person.
Unless otherwise agreed in writing or provided in our Privacy Policy, submissions should not be considered confidential.
By voluntarily submitting content for publication or promotional use, you grant Build Ohio First and Powering Prosperity a non-exclusive, royalty-free right to use, reproduce, display, distribute, adapt, and publish that content in connection with their activities, subject to applicable law.
Personal information submitted through registration, advocacy, or contact forms is handled as described in our Privacy Policy.
THIRD-PARTY SERVICES AND LINKS
The Site may contain links to websites, resources, social-media services, advocacy platforms, or other services operated by third parties.
Those links are provided for convenience or informational purposes. Build Ohio First and Powering Prosperity do not control third-party services and are not responsible for their content, availability, security, privacy practices, accuracy, or operation.
The inclusion of a third-party link does not necessarily constitute endorsement of that third party or its content.
Your use of third-party websites and services is at your own risk and may be subject to their separate terms and policies.
INFORMATIONAL AND ADVOCACY CONTENT
Information provided through the Site is intended for general informational, educational, and advocacy purposes.
Although we seek to provide useful and accurate information, Build Ohio First and Powering Prosperity do not warrant that all information on the Site will always be complete, current, accurate, or free from error.
Nothing on this Site constitutes legal, financial, investment, engineering, or other professional advice.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
INDEMNIFICATION
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Build Ohio First, Powering Prosperity, and their respective officers, directors, employees, agents, contractors, and affiliates from claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, violation of these Terms, or infringement of another party’s rights.
TERMINATION
We reserve the right to restrict, suspend, or terminate your access to all or any portion of the Site at any time if we reasonably believe you have violated these Terms, applicable law, or the rights of Build Ohio First, Powering Prosperity, or another party.
Provisions that by their nature should survive termination—including provisions concerning intellectual property, disclaimers, limitations of liability, and indemnification—will continue to apply following termination.

Your use of the Site is also subject to the Build Ohio First Privacy Policy.

GOVERNING LAW
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where otherwise required by applicable law.

SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
CHANGES TO THESE TERMS
We may revise these Terms periodically.
When changes are made, the Effective Date at the top of these Terms may be updated. Your continued use of the Site after revised Terms are posted constitutes your acceptance of those Terms.
